A fresh controversy has hit President Bola Tinubu’s cabinet as the Federal High Court in Abuja has granted leave to the Independent National Electoral Commission (INEC) to prosecute the Minister of State for Labour and Employment, Hon. Nkeiruka Onyejeocha, over alleged forgery of election results during the 2023 general elections.
The court’s ruling followed an ex-parte motion filed by Hon. Amobi Godwin Ogah, a member of the House of Representatives representing Isikwuato/Umunneochi Federal Constituency of Abia State, who accused the minister of falsifying election results from 62 polling units in the constituency.
Delivering his ruling on September 23, 2025, Justice M.G. Umar held that Ogah had provided sufficient grounds and supporting evidence in his affidavit to warrant the court’s approval for INEC to initiate prosecution.

“I am satisfied that the applicant has placed relevant materials in his affidavit in support of this application, and this court is persuaded to exercise its discretion in his favour,” Justice Umar ruled. “An order is hereby made granting leave to the applicant to apply for an Order of Mandamus compelling the Independent National Electoral Commission (INEC) to investigate and prosecute Nkeiruka Chidubem Onyejeocha for the electoral offence of forging election results in polling units within Isikwuato/Umunneochi Federal Constituency of Abia State.”
The legal battle between both politicians dates back to the aftermath of the 2023 general elections. Onyejeocha, who contested under the platform of the All Progressives Congress (APC), had approached the National and State Houses of Assembly Election Petition Tribunal to challenge Ogah’s victory, claiming she won the election.
However, Ogah, who ran on the Labour Party (LP) platform, accused the minister of tendering falsified result sheets, marked as Exhibit 3, before the tribunal in an attempt to overturn his victory.
In his affidavit before the court, Ogah alleged that “Hon. Nkeiruka Onyejeocha forged the results in respect of several polling units, which were presented at the tribunal as authentic documents issued by INEC.”
He further stated that the minister “attempted to mislead the judiciary by presenting forged documents to both the Election Tribunal and the Court of Appeal as genuine INEC results.”
Following the tribunal’s proceedings, Onyejeocha lost her petition, confirming Ogah’s election victory. Subsequently, Ogah approached the Federal High Court to compel INEC to take action against the alleged forgery.
The court’s latest decision, therefore, paves the way for INEC to commence investigation and possible prosecution of the serving minister for alleged electoral offences.
The development marks another scandal within the Tinubu administration, coming at a time when the government faces growing public scrutiny over integrity and accountability among cabinet members.
If INEC proceeds with the prosecution, it would be one of the first high-profile cases involving a serving minister accused of forging electoral documents in Nigeria’s recent history.
