Speaker Amaewhule, Other Wike Loyalists Win At Appeal Court, Return As Rivers Lawmakers

The expulsion of Martin Amaewhule and twenty-four other people from the Rivers State House of Assembly by the Rivers State High Court has been overturned by the Court of Appeal located in Abuja. The exparte ruling could not have been granted by the lower court, according to a three-member panel of the court. According to the Ajapareporter.com, The Federal High Court is authorized by Section 272(3) of the Constitution, the court claims, to ascertain whether a member of the House of Assembly has vacated their seat. It was decided that the only body with the authority to decide whether or not the seats are vacant is the Federal High Court.

The appellate court went on to say that all state high courts are immediately disqualified from having jurisdiction because the Federal High Court is specifically mentioned in Section 272(3) of the Constitution.
